The DERATANY FIRM, located in Chicago, Illinois, filed suit on behalf of the biological parents of a minor child who beaten while in foster care. The child’s parents, Mariam Lee and Bernard Hightower are suing the foster care agencies, National Mentor and its subsidiary, Illinois Mentor, the foster care agencies responsible for the placement of the child. The parents are also suing the foster parents and the case worker involved in the case.
Plaintiffs Mariam Lee and Bernard Hightower allege that their daughter was placed in foster care with the defendant Booker Terry who battered and beat her on her head causing the child to suffer severe brain damage. The complaint further alleges that Booker Terry was not a licensed foster parent and it was illegal and against DCFS policies to place the child in that home.
The Plaintiffs allege that the defendant foster care agencies and its employees knew that Booker Terry had a history of violence and committed acts of violence against their daughter. Moreover, the Plaintiffs allege that Illinois Mentor, National Mentor, and the foster care worker were specifically warned that the minor child was bruised and was possibly being abused in the Terry home, however the agencies and foster care worker refused to take appropriate action to remove the child from the foster care home.
